"How does a mediator differ from a lawyer? Are lawyers involved in mediation?"
A divorce lawyer acts on behalf of his or her client and represents the interests of that individual client. A mediator, on the other hand, acts as a neutral third party and helps both spouses make sense of each other's interests and concerns and, ultimately, compromise and reach an agreement. The parties are encouraged to consult with independent legal counsel who may or may not participate in the mediation. If the parties reach an agreement, it is filed in the court record and a divorce is obtained. If they can't reach an agreement, the discussions remain confidential and cannot be disclosed in any court hearing. As such, you don't give up any rights by attempting mediation, and if it is successful, there is much to be gained.
