Personal
Injury and Wrongful Death
The
Denman Law Firm specializes in trial practice representing victims
of accidents who have sustained serious personal injuries or family
members who have lost a loved one due to the negligence or wrongdoing
of others. We have successfully represented victims of accidents
for over 26 years! If there is no recovery then we charge no attorneys
fees! Although less than 10% of all personal injury cases are tried
in court, we believe that a case well prepared for trial will result
in a good settlement, if one can be reached. Examples of the type
of cases we handle are discussed below:
MOTOR VEHICLE ACCIDENTS:
When vehicle occupants are seriously injured due to the failure
to use due care by another vehicle operator they deserve to be compensated.
Typically, the operator of another vehicle due to negligence hits
the vehicle the victim is riding in by rear ending it, running a
stop sign or red light, cutting it off or in other ways endangers
the victim due to negligence. We fight for our clients right to
be reimbursed for their medical, nursing and hospital bills and
lost wages along with compensation for bodily injuries, pain and
suffering, mental anguish and disability.
AVIATION ACCIDENTS:
We have more than 26 years experience in handling aviation accident
and insurance cases. Frequently, in general aviation accident cases
aircraft liability insurers seek to deny insurance coverage to aircraft
owners, pilots and injured passengers. Jim Denman is known to be
an expert in the law relating to aviation insurance coverage. He
has played a significant role in the development of aviation insurance
coverage jurisprudence in the late 1970's and 1980's. In recent
years The Denman Law Firm has represented victims of aircraft accidents
and family members of loved ones lost due to aircraft accidents
involving faulty maintenance, failure of aircraft engine components,
and fuel exhaustion.
DEFECTIVE PRODUCTS AND PRODUCT FAILURES:
The Denman Law Firm has extensive experience in analyzing and evaluating
the role product defects or failures have had in causing accidents
involving serious injuries or death. We invariably involve product
experts and engineering consultants to assist us with this. We attempt
to thoroughly understand all the legal and engineering aspects of
our products liability cases and to creatively articulate the complexity
of the product defects or failures in an understandable way to judges
and juries. If a product defect or failure causes injuries or death,
the injured victim or survivor may recover money damages from the
manufacturer, distributor and/or retailer of the product. Often
the failure to provide an adequate warning or instruction for a
hazard known to the manufacturer or reseller of the product may
render the product defective. In recent years The Denman Law Firm
has represented clients permanently impaired or injured due to dangerous
chemicals, aircraft component failures, exercise equipment failures,
and as a result of other similar product defects or failures. We
sometimes call product liability litigation "people protection"
because it encourages engineering improvements in commercial products
so as to prevent injuries to others in the future due the same defects
or failures.
PREMISES LIABILITY:
In recent years the courts have held owners and occupants of commercial
premises to be responsible for injuries from foreseeable attacks
as a result of the failure to provide needed security. A business
owner or occupant is required to keep its premises reasonably safe
for business customers. Similarly, a business customer has a right
to expect a safe condition of the premises. A well known premises
liability scenario involves the "slip and fall". Under
these circumstances a business owner or occupant has a duty to its
customer to remove foreign substances and objects from the the walking
areas on its premises within a reasonable time after its presence
becomes known or should have been known. If the failure to do this
results in injuries to the customer of the business owner or occupant
due to their negligence then the customer may have a cause of action
for compensation. Investigation early after a premises accident
before changes occur to the premises may be critical to a successful
outcome of the claim by the client.
ANIMAL ATTACKS: The
most frequent type of injuries caused by animals is by vicious dogs.
The Denman Law Firm in recent years has successfully represented
victims of dog attacks. Florida law makes the owner of a vicious
dog and some other domesticated animals strictly liable for injuries
the animal causes to others, absent provocation or a qualifying
"Bad Dog" sign.
BOATING AND MARITIME ACCIDENTS:
The Denman Law Firm has been called upon to represent seamen injured
due to unseaworthy and dangerously outfitted and equipped vessels.
The firm has also represented passengers in boating accident cases
occurring in navigable waters. Boating accidents may occur from
dangerously slippery decking due to spillage or interior leaks,
capsizing, falls overboard, collisions, fire, sinkings, and explosions.
Cruise Line accidents involving injuries to passengers from poorly
marked raised thresholds and foreign matter on ship decks are common
occurrences on cruises departing ports in Miami and Fort Lauderdale.
TRAUMATIC BRAIN INJURIES:
The Denman Law Firm has in recent years handled cases involving
closed head injuries. Mild to moderate traumatic brain damage can
occur from a direct blow to the head, and from the brain undergoing
a rapid acceleration/deceleration movement (i.e. such as with a
whiplash ) without direct external trauma to the head. A common
misconception is that loss of consciousness is required for permanent
brain injury.
WRONGFUL DEATH: A
legal cause of action for wrongful death may arise when a person
dies as a result of the negligence of another. Causes of death may
involve one of the types of accidents above. Under the often, difficult
emotional circumstances of these cases we try to be sensitive to
the loss our clients have suffered while working diligently to help
them recover the compensation the law allows.
