ESTATE PLANNING, ASSET PROTECTION, FAMILY BUSINESS SUCCESSION PLANNING AND RETIREMENT PLANNING: The Denman Law Firm is committed to assisting our clients in their goal to avoid probate of their estate, and to protect and preserve hard earned assets from taxes (estate, gift and income taxes). We seek to develop a plan of distribution upon death that is consistent with our clients desires. The centerpiece of an estate plan may be a will or trust depending upon our client's individual needs.  As a value added service we offer Financial Planning and Wealth Management services to our clients to assist them in reaching their investment and retirement goals.

The Economic Growth and Tax Relief Reconciliation Act of 2001 that became law on June 7, 2001 affects almost all existing estate planning and wealth protection plans. In addition, the Health Insurance Portability and Accountability Act of 1996 (HIPPA) and the regulations implementing it have made it impossible for families to secure medical information regarding their loved ones without proper releases and provisions being added to estate planning documents.  Our firm is ready and equipped to review, make recommendations for changes and update our clients existing estate plans. A part of that function focuses upon planning for the possibility of a breadwinners disability or incapacity by preparing Durable Powers of Attorney and Advance Health Care Directives. Planning and implementing plans for succession of ownership and control of family businesses is another important area in which we assist our clients as well.  Financial Planning, wealth and investment management, retirement and asset protection, are natural and value added services that our firm offers to our clients.

DISABILITY AND MEDICAID PLANNING:  We frequently are called upon to assist families with Elder Law issues including disability and medicaid planning for seniors.  We work with other professionals, including care managers and accountants to assist seniors and their family members in dealing with the unique issues associated with aging and illnesses associated with aging.  It is always our goal to help facilitate seniors to continue to receive any needed care in the home rather than through a nursing home.  We are equipped to assist families with the financial planning required to secure public benefits through medicaid.

PROBATE AND TRUST ADMINISTRATION: We assist heirs and beneficiaries who have lost loved ones in the probate and administration of the deceased's estate. In this regard, we are called upon to defend some claims of creditors and less often a will contest by those claiming an interest in the estate while assisting the Personal Representative in ultimately making final distributions and closing the estate.  We also assist our clients with administration of trusts when a loved one passes away including selection of the proper investments to carry out the investment objectives set forth in the trust.

BUSINESS AND OTHER CIVIL LITIGATION: As litigation has become more and more expensive, the courts and lawyers have sought alternative methods of dispute resolution. Our firm's philosophy is to utilize creative methods of dispute resolution so as to avoid costly litigation when possible. One method that has proven effective in accomplishing this is mediation. Mediation utilizes a neutral, trained and certified person, usually a lawyer, to serve as a "go between" the other parties involved and our client. The mediator seeks to determine the areas of disagreement and help the parties find alternative solutions to resolve their dispute. When settlement of disputes is not possible we take our cases to trial as may be required.
